You are solely responsible for any User Content you submit, upload, or share on the Platform. You represent and warrant that:

• Your User Content does not infringe any third-party rights
• Your User Content complies with these Terms and applicable laws

You must not upload or share User Content that:

5.3 Licence to User Content

By submitting User Content, you grant fanlens a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and promoting the Platform.

This licence continues even if you stop using the Platform, but you may request removal of your User Content by contacting us.

5.4 Content Moderation

We reserve the right (but have no obligation) to:

• Monitor, review, and moderate User Content
• Remove or refuse to publish any User Content
• Suspend or terminate accounts that violate these Terms
• Cooperate with law enforcement authorities

5.5 No Endorsement

We do not endorse any User Content and are not responsible for its accuracy, completeness, or quality.

6. Intellectual Property Rights

6.1 Platform Ownership

The Platform, including its design, code, features, functionality, and original Content, is owned by fanlens and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes.

6.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the Platform
• Reverse engineer or decompile the Platform
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Platform or Content for commercial purposes without authorisation

"fanlens" and our logo are trademarks of fanlens. You may not use our trademarks without prior written consent.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FANLENS SHALL NOT BE LIABLE FOR ANY:

10.2 Cap on Liability

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED £100 (ONE HUNDRED POUNDS STERLING).

10.3 UK Consumer Rights

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any matter for which it would be illegal to exclude or limit liability

Your statutory rights as a consumer under UK law are not affected by these Terms.

11. Indemnification

You agree to indemnify, defend, and hold harmless fanlens, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your User Content
• Your violation of any rights of another person or entity
• Your violation of any applicable law or regulation

12. Copyright and DMCA

12.1 Copyright Policy

We respect intellectual property rights and expect users to do the same.

12.2 Reporting Infringement

If you believe that content on the Platform infringes your copyright, please contact us at copyright@fanlens.com with:

• Identification of the copyrighted work
• Identification of the allegedly infringing material

• A statement of good faith belief that use is not authorised
• A statement that the information is accurate and you are authorised to act
• Your physical or electronic signature

12.3 Counter-Notification

If your content was removed due to a copyright claim and you believe it was removed in error, you may submit a counter-notification.

12.4 Repeat Infringers

We may terminate accounts of repeat infringers.

13. Privacy and Data Protection

14. Modifications to Terms

• We may delete your account and User Content
• Provisions that by their nature should survive (including liability limitations and dispute resolution) remain in effect

16. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

16.2 Jurisdiction

Subject to the arbitration clause below, you agree to the exclusive jurisdiction of the courts of England and Wales.

16.3 Informal Resolution

Before initiating formal proceedings, please contact us at legal@fanlens.com to attempt to resolve the dispute informally.

16.4 Arbitration

For disputes that cannot be resolved informally, you agree to binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA), except where prohibited by law.

16.5 Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class, collective, or representative action.

16.6 UK Consumer Rights

Nothing in this section affects your statutory rights as a consumer under UK law, including your right to take action in the UK courts.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and fanlens regarding the Platform.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

17.5 No Agency

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and fanlens.

17.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, strikes, or internet disruptions.
